The Gifting Stories(TGS) – Terms and Conditions
1. Delivery Timings:
a) For all the Next Day Orders, orders have to be made before 2 pm on the same day. All orders made after this shall be considered for delivery latest by the next to next day.
b) We do not guarantee any timed delivery, our regular delivery timings are between 9:00 am to 9:00 pm. Clients can request specific timings in the Special Instructions section of payment form, we will try our best to honour the client’s request but cannot commit 100% efficiency in the timing of delivery.
c) Delivery timings if promised cannot be guaranteed in case of special circumstances like extreme weather conditions, riots, strikes, elections, bandhs, during rush hour days like Valentine’s Day, Mothers Day, Rakhi, New year Eve etc, the order cancelation would not be possible in such circumstances
3. Discounts: All the discounts are decided by TGS team and none of the Discount and offers can be clubbed together.
4. Address Change: Any changes to the recipient address would be entertained free of cost if they are requested before processing the orders. Changes after that will not be entertained and order would not be canceled. Change of address would not be possible for products from the gift section after dispatch.
5. Order Change: Any changes to the order would be entertained with monetary adjustments if requested before 24 hrs of the actual delivery. Changes after that will not be entertained and order would not be canceled. Cancellation charges of 5% are applicable on all cancellation requests
6. Delivery Product: The products/services provided on this site are without warranties of any kind either expressed or implied and The Gifting Stories (TGS) disclaims all or any of them fully. TGS does not warrant that the products/services offered will be error-free, or that the defects will be corrected, or that this site or the server that makes it available are or will be free of viruses or other harmful components.TGS shall be responsible for fulfilling your orders (either directly or through its delivery partners) including but not limited to issue invoice, deliver product to recipient, and in no event shall any of its affiliate, director, representative, officers, consultant or employee be responsible for transactions made on this Website.
7. Damaged deliveries: We will cater to any reports of damaged products within 24 hours of delivery @ support@thegiftingstories.com . The problem report must be supported with substantial proofs of the damage made to the product.
8. Rules for delivery:
a) Delivery will be made as per the delivery instructions. e.g. if delivery instructions state that the product must be delivered to the recipient only, it will not be given to any one else and shall be considered delivered if recipient is not available. If recipient doesn’t accept the delivery, we shall consider the order to be delivered. Before any festival or major occasions, we suggest you to place your order at least 5 (five) days in advance
b) We , TFS , will be able to attempt delivery of your gifts only ONCE. In the event the delivery is not executed during the attempt, the customer shall still be charged for the order and no redelivery will be possible. We will consider the order executed in the below cases:
1. Wrong shipping/delivery address.
2. Recipient not available.
3. Premises locked.
4. Wrong landlines / Mobile number or Extension number which may render us unable to reach the recipient for the delivery.
5. Recipient refusing to accept the delivery.
6. Delivered the product at the Gate/ Reception/ Neighbor.
Payment Terms
You agree to pay the price applicable and displayed for the product or service on our Website at the time you submitted your order, the delivery fees for the delivery service you selected, if any, or any applicable taxes (defined below). You will be solely responsible for payment of all taxes (other than taxes based on TGS’s income), fees, duties, and other governmental charges, and any related penalties and interest, arising from the purchase of the products and services not withheld by TGS.
All payments are non-refundable . TGS is liable to Refund the Full amount only in the condition where TGS will Reject the Order after Receiving the same or Not able to deliver the Product . Order delivery is totally subjected to the payment credited in TGSs account. Unless payment is received by us, the order will not be processed. You acknowledge that while making transaction on the website, you are not using any Credit or Debit card, digital wallet or UPI id fraudulently and you are duly authorized to use such card or payment mechanism. You agree to provide accurate and correct information of your card or the payment mechanism for such transaction. The liability for use of a card or any payment mechanism fraudulently will be on you and the onus to ‘prove otherwise’ shall be exclusively yours. TGS doesn’t take the responsibility of any transaction which is processed without your consent and knowledge. The cardholder or the holder of any payment mechanism is solely and totally liable for the transactions and the amount charged on his/her A/c.
Communication
Subject to terms of use and your registration on our Website, you agree to receive communications from us by e-mail, SMS or any other communication made electronically, verbally or physically through post. You agree that all agreements, notices, disclosures and other communications that TGS provides to you by e-mail or in any other aforementioned mediums satisfy any legal requirement that such communications be in writing. TGS being an occasion based gifting business, provides certain occasion reminder services wherein TGS would remind you in future year(s) concerning certain occasions. For this purpose, you agree to give your consent to be contacted by TGS through SMS, phone call and e-mail on your registered phone number and email id, to assist you with free occasion reminder service.
Feedback & Suggestion
At TGS, we make every effort to ensure that you receive excellent products and services. We strive hard not only to meet but exceed your expectations. If, at any time, you experience problems with an order or are not happy with our services, you can write to us at support@thegiftingstories.com. Your feedback and suggestions are important to us. Note: Complaints need to be made within 24 hours from the time of delivery, after which we will not be able to register any complaints.. In case of a defective or a bad quality product complaint, we will replace it. For quality purpose, we might have to get a reverse pick up done for that product before we can get a redelivery done.
Refund and Return Policy
No returns are allowed. However, if the product received is damaged/defective/Wrong, then please report the issue to our customer support team within 24 hrs of delivery along with an image of the item delivered. Our team will contact you for additional details of the product delivered if required. You may choose one of the following:
1. Get the product re-delivered or
2. Opt for a refund in the form of a gift certificate (refunded within 24 hours) or
3. Refund in the original mode of payment (amount shall reflect in your account within 7-10 working days as per standard banking timelines)
We do not offer refund in the following cases:
- If Flowers, Plants, Cakes, Sweets or any other perishable items are delivered to an incorrect address provided by the sender.
- If the recipient is not present at the delivery address provided by the sender or refuses to accept the delivery.
- If product quality concerns are caused by improper handling of the product.
Note: –
- Complaints need to be made within 24 hours from the time of delivery, after which we will not be able to register any complaints.
- Complaints against non-delivery need to be made within 15 days from the date of delivery, after which we will not be able to register any complaints.
- For quality purpose, we might have to get a reverse pick up done for that product, before we can get a redelivery done.
- We do not accept any request for product exchanges.
- In the event that we are unable to supply all or part of your order (the product or any substitute product to you at all), we shall notify you as soon as possible and reimburse your payment for the part undelivered.
- Online refund will be processed by TGS on confirmation through email or phone call to the customer.
- Once the refund is processed by TGS, it takes 10 to 15 business days to reflect in your account as per standard banking timelines.
9. Substitution Policy
Occasionally, substitutions of flowers or containers are necessary due to temporary, regional availability issues. If this is the case with the gift you have selected, our experienced florists will ensure that the style, theme and color scheme of your arrangement is preserved and will only substitute items of equal or higher value. We, however, reserve the right to substitute the flowers (Including specified color) / other products with equal or higher value in case of none availability of the desired product.
Fraudulent Transactions
If TGS finds any customer involved in any fraudulent transaction on the Website, it may recover the cost of products, collection charges and lawyer’s fees from the concerned customer using the Website fraudulently. Such recovery shall not prejudice the rights of TGS to initiate legal proceeding against such customer for his/her unlawful activities.
Privacy Colicy
Your registration data and other information collected through the use of this Website is subject to the Privacy Policy. You acknowledge that through your use of this Website, you consent to the collection and use (as set forth in the Privacy Policy) of this information, including the transfer, as necessary and permitted under the applicable laws. 11. Dealing with Fraudulent Customers:
If we find out any fraudulent behavior from any client in terms of wrong address, unethical message, odd delivery timings or any other reason, we hold the power to reject that order or ban that customer without being answerable to any one.
12. Rules for unfounded recipient:
In case the final customer is not available for receiving the placed order and we have strict instructions to deliver only to the intended customer the order shall be considered delivered and no refund will be made. Please refer Cancellation and refund policy for further details.
13. All courier items will be shipped using BlueDart or equivalent courier. As such we cannot specify any delivery date or timing for such order. All orders will be delivered between 9 am – 7 pm and may take 3-9 days of shipping time depending on the product, availability and other parameters.
14. We hold the right to extend our services to any individual, organization, group or business unit. We may refuse to serve any individual, organization, group or business unit solely on our own will and we will not be answerable to anyone.
15. TGS may amend its Terms & Conditions from time to time. These terms shall be governed by and constructed in accordance with the laws of India without reference to conflict of laws principles and disputes arising in relation hereto shall be subject to the exclusive jurisdiction of the courts at Karnal.
16. These Terms and Conditions, together with TGS’s cancellation and refund policy, Privacy Policy, Disclaimer and other rules and policies posted on the site, which are hereby incorporated as if set forth fully in these Terms and Conditions, constitute the entire agreement between you and TGS with respect to your use of and material available on the site, and they supersede all prior or contemporaneous communications and proposals between you and TGS with respect to this site. Any rights not expressly granted in these Terms and Conditions are reserved.
17. I understand that TGS can send transactional and promotional SMS, Call, Whatsapp & Emails on my registered id & number.
18. TGS’s objective is to provide the best service and quality products, and to ensure the same, TGS might contact the receiver seeking the feedback.
19. In any case, if the order is placed by any individual unethically from TGS . This will be considered as part of a fraud. The company has the right to cooperate with competent law enforcement agencies and to ask them to take appropriate action whenever such phenomena occur. Additionally, the company will notify the police or other competent authority.
20. Account Deletion:
To close your account, you can send us an email with the subject “Termination”. Our team will contact you and confirm the cancellation of your account by email. You will no longer be able to log in or access your account, retrieve or edit content or information, or view your account history and will no longer be able to receive calls or emails from Flower Aura. Your account will be deleted at your request within 30 days. If you do not wish to delete your account, you can contact our team before the 30 days expires.
21. TGS never asks for any of your personal bank details. Please do not share your personal bank details like Card Number/Pin/CVV/OTP/Card Expiry Date/UPI Pin, over Phone/Mail/SMS to anyone.
